PERSONAL DATA AND THEIR PROCESSING
When you order the paid Call Smartly service through your user account, which in some cases includes a free trial, as described in the Terms, we ask you to provide us with your first name, last name and address (collectively referred to as “Personal Data”).
You agree that your Personal Data may be processed by TOP PORADCE s.r.o., Široká 36/5, 110 00 Prague 1, Czech Republic, Id. No.: 28866291 (“Provider“). The Provider is in the position of a personal data controller and has a registration by the Office for Personal Data Protection of the Czech Republic (reg. no. 00060114).
You agree that you provide all your Personal Data voluntarily. You agree to provide accurate, truthful and current Personal Data and keep it up to date. Failing to do so will result in consequences as set forth in the Terms.
The Provider does not collect nor has access to any of the data you use while using the Call Smartly mobile app, e.g. the telephone numbers you dial.
When you create an online user account to become Call Smartly registered user as described in the Terms, we will ask you to provide us as your unique identification the telephone number of the phone you will have downloaded the Call Smartly mobile app on and your email, as indicated in the Call Smartly mobile application registration form („Registration Data“).
You agree that you provide all your Registration Data voluntarily. You agree to provide accurate, truthful and current Registration Data and keep it up to date. Failing to do so will result in consequences as set forth in the Terms.
We do not collect nor have access to your telephone number as we assign a unique identification code to it once you enter it in the registration form and send the form to us.
TECHNICAL AND ANONYMOUS DATA
When you use Call Smartly, or any part thereof, we may collect information about your mobile device and system, pages viewed and/or features used, general traffic data, location data, and other communication data.
PURPOSE OF DATA PROCESSING
The purpose of processing your Registration and Personal Data lies mainly in setting up and maintaining your Call Smartly user account and ensuring that you will be able to use the online features of Callsmartly.com, whether they are free or paid.
The purpose of the collection of technical and anonymous data is to ensure quality, increase your comfort and further analyse and develop Call Smartly, or any part thereof, and related services.
We may also, from time to time, use anonymized data generated by your using of Call Smartly, or any part thereof, in order to aggregate, benchmark, and provide metric data for research purposes, for marketing purposes, or to provide further services to our clients.
SHARING YOUR INFORMATION WITH THIRD PARTIES
We may disclose user information (i) pursuant to lawful requests (such as subpoenas or court orders), (ii) in compliance with applicable laws, rules and regulations, (iii) to prevent fraud or other illegal activity perpetrated through Call Smartly or using our names and/or trademarks, (iv) to prevent imminent bodily harm, or (v) when we believe it is necessary to protect our interests or property. This disclosure may include sharing user information with other companies, lawyers, agents or government agencies.
Provider does not provide Personal Data to third parties, except as required by the applicable laws. However, Personal Data may be processed for Provider by third parties, but only for the purposes specified in this Policy, on a basis of written contract and under statutory conditions.
COMMUNICATION AND OFFERS
You hereby agree that the Provider may use the Registration and/or Personal Data provided by you to send commercial offers and communication with respect to Call Smartly, related services or services of business partners associated with the Provider.
TERM OF THE PROCESSING
Personal Data is being processed while you use the Call Smartly and until your consent to the processing is withdrawn by you.
PERSONAL DATA CORRECTION AND DELETION
You hereby acknowledge that you are entitled to withdraw your consent to the processing of your Personal Data at any time, you have the right to access, correct or discard your Personal Data or remove them if misleading. Furthermore, you are entitled to contact the Provider in writing with any complaint concerning the processing of your Personal Data and, in case of dissatisfaction with the answer, consult the Office for Personal Data Protection of the Czech Republic.
Your consent to the processing of your Personal Data may only be withdrawn by sending a written notice to the address of the Provider. If your consent to Personal Data processing is withdrawn, the paid features of your Call Smartly user account will be disabled and you will be able to use the free features and services only as set out in the Terms.
The Provider takes precautions to protect the users' information. Your account information is located on a secured server behind a firewall. When you enter sensitive information (such as any of your Registration or Personal Data or your password), it gets encrypted using secure socket layer technology (SSL).
Because email and instant messaging services are not recognized as secure communications, the Provider requests that you not send private information to them by email or instant messaging services.
CALL SMARTLY AND ITS CONTENT ARE PROVIDED "AS IS" AND THE PROVIDER EXCLUDES TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. THE FUNCTIONS EMBODIED IN, OR IN THE MATERIALS OF, CALL SMARTLY, OR ANY PART THEREOF, ARE NOT WARRANTED TO BE UNINTERRUPTED OR WITHOUT ERROR. YOU, NOT THE PROVIDER, ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION DUE TO YOUR USE OF CALL SMARTLY, OR ANY PART THEREOF.
